Websites in the face of German competition law

Right on Belgium's doorstep, the German market is extremely accessible for Walloon companies. Its geographic proximity, resulting in limited expansion costs and the opportunity to reach a German-speaking customer base simply by translating a website into German, are significant considerations for any Walloon company.

However, there are some difficulties for foreign companies wanting to develop in Germany. A company with a German website is subject to German law and specifically German competition law. Yet, under the German legal system, a competitor believing that his rights have been infringed can issue a caution to the alleged perpetrator. This action can quickly lead to a court judgement banning the website and enforcing financial penalties and must therefore be taken very seriously.

However, these difficulties are far from being insurmountable and beyond its legal obstacles Germany is brimming with genuine opportunities for Walloon companies.
